These Terms of Use (“Terms”) are a legal agreement between you and America Josh LLC (“America Josh,” “we,” “us,” or “our”).

Please read these Terms carefully before using our websites and services. By accessing or using any part of our Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use the Service.

The Service

These Terms govern your access to and use of the websites, content, community spaces, events, and related services that we operate, including:

They also apply to the online communities, groups, directories, newsletters, and events that we run, including community spaces we host on third-party platforms such as Facebook and LinkedIn. We refer to all of these collectively as the “Service.”

Where a community space sits on a third-party platform, that platform's own terms also apply to your use of it, in addition to these Terms.

Eligibility

The Service is intended for adults. You must be at least 18 years old to create an account, register for an event, make a purchase, or post content. Some events serve alcohol and carry their own age requirements (21 or older for alcohol service in the United States); where that applies, it is stated at the point of registration and enforced on site.

By using the Service, you confirm that you meet these requirements and that the information you give us is accurate.

Changes to These Terms

We may modify these Terms from time to time. If a change is material, we will try to provide at least 15 days' notice before it takes effect, such as by posting a notice on the Service or updating the date above. What counts as a material change is determined at our discretion.

By continuing to use the Service after changes take effect, you agree to the revised Terms. If you do not agree, please stop using the Service.

Informational Purpose Only — No Professional Advice

America Josh publishes information and general guidance for Australians living in or moving to the United States, including content about visas and immigration, tax, banking, healthcare, housing, and everyday life. This content is provided for general informational purposes only.

You agree to the following:

Nothing on the Service is legal, immigration, tax, accounting, financial, medical, or other professional advice, and nothing on the Service should be relied on as a substitute for advice from a licensed professional who knows your specific circumstances.
No professional relationship is created between you and America Josh by your use of the Service. Using the Service does not create an attorney-client, advisor-client, fiduciary, or any other professional relationship.
Your reliance on any information is at your own risk. Laws, rules, prices, processing times, and government procedures change frequently and vary by individual situation. We do not guarantee that any information is current, complete, or accurate for your circumstances.

From time to time we introduce, recommend, or feature third-party service providers, including immigration attorneys, tax advisers, mortgage and financial professionals, and other businesses.

A referral or feature is an introduction, not an endorsement, guarantee, or warranty of that provider or of any outcome.
Any service you obtain from a third-party provider is a matter solely between you and that provider, governed by their own terms, and is their responsibility, not ours.
We are not liable for the acts, omissions, advice, products, or services of any third-party provider, and we make no representation about their qualifications, licensing, or performance.

You are responsible for doing your own due diligence before engaging any provider, including confirming that they are appropriately licensed for your needs.

The Service is supported in part by affiliate relationships and sponsorships.

Some links on the Service are affiliate links. If you click one and take an action (such as signing up or making a purchase), we may earn a commission at no additional cost to you.
Some content is sponsored or produced in partnership with a brand or provider. We aim to identify sponsored content where it appears.
These commercial relationships do not change the obligations set out above: a featured or affiliated provider is still not endorsed or guaranteed by us, and you still engage them at your own discretion and risk.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of America Josh LLC and its licensors, and are protected by United States and international intellectual property laws.

This includes our names, logos, and brands, such as “America Josh,” “Australians in the USA,” “Big Aussie BBQ,” “Big Aussie Cheer Squad,” and “Big Aussie Trivia,” together with the look and feel of the Service. You may not use our names, logos, or brands without our prior written permission.

You may view and share our content for personal, non-commercial use with attribution and a link back to the source. You may not copy, republish, sell, or commercially exploit our content without our prior written permission.

Copyright Complaints

If you believe content on the Service infringes your copyright, please contact us at [email protected] with enough detail to identify the work, the allegedly infringing material and its location, your contact information, and a statement of your good-faith belief that the use is not authorized. We will review and respond, and we may remove material we determine to be infringing.

User Content and Community Conduct

Parts of the Service let you post content, such as comments, messages, group posts, event submissions, and profile information (“User Content”). You are responsible for the User Content you post.

License to us. By posting User Content, you grant America Josh a non-exclusive, royalty-free, worldwide license to use, host, store, display, reproduce, and distribute that content in connection with operating and promoting the Service. You keep ownership of your content; this license only lets us run and promote the community.

Your promises. You confirm that you own or have the right to post your User Content, and that it does not infringe anyone's rights or break any law.

Acceptable use. You agree not to post or do anything that is unlawful, harassing, hateful, threatening, defamatory, deceptive, infringing, or spam, and not to impersonate others, scrape or harvest data, interfere with the Service, or attempt to gain unauthorized access to it. Within our communities, treat other members with respect.

Removal. We may remove any User Content and suspend or remove any member, at our discretion and without notice, including for breaching these Terms or our community standards. We are not obligated to monitor User Content, and we are not responsible for content posted by members.

Events

We run in-person and online events, some of which are ticketed.

Registration and payment. Tickets and registrations are sold through third-party platforms, including Humanitix and Stripe. Those platforms' terms also apply to your purchase. Event-specific terms, including price, age requirements, and any refund or cancellation policy, are stated at the point of registration and on the event listing, and they govern that event.

Cancellation and changes. We may change, reschedule, or cancel an event, including its date, venue, lineup, or format. Where an event is canceled by us, any refund will be handled according to the refund policy stated for that event.

Code of conduct. By attending, you agree to follow event rules and the directions of staff and the venue, to behave respectfully, and to comply with all venue and legal requirements, including those relating to alcohol service. We may refuse entry to or remove anyone who behaves unsafely or inappropriately, without refund.

Assumption of risk. Attendance at any in-person event is at your own risk. To the fullest extent permitted by law, America Josh is not liable for personal injury, illness, loss, or property damage arising from your attendance, except to the extent caused by our gross negligence or willful misconduct.

Photography and likeness. We photograph and record our events for community and promotional purposes. By attending, you consent to being photographed, filmed, and recorded, and you grant America Josh permission to use your image, voice, and likeness in our content and marketing, without compensation. If you do not wish to appear, please tell our staff on site or contact us in advance, and we will make reasonable efforts to accommodate you.

Payments

Payments on the Service are processed by third-party payment providers, including Stripe and Humanitix. We do not store your full payment card details. Your payments are subject to the terms and privacy practices of the relevant payment provider, and you agree to those terms when you make a purchase.

Links to Other Websites

The Service may contain links to third-party websites or services that we do not own or control. We have no control over, and assume no responsibility for, the content, policies, or practices of any third-party website or service. We are not responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with your use of or reliance on any third-party website or service. We encourage you to read the terms and privacy policies of any third-party website or service you visit.

Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any information on the Service is accurate, complete, or current.

Limitation of Liability

To the fullest extent permitted by law, America Josh LLC and its owners, members, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us, if any, in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless America Josh LLC and its owners, members, employees, contractors, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your attendance at an event, or your breach of these Terms or of any law or third-party right.

Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.

All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, limitation of liability, and indemnification.

Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts.

General

Our failure to enforce any right or provision of these Terms will not be a waiver of that right or provision. If any provision is held to be invalid or unenforceable, the remaining provisions will remain in full effect. These Terms are the entire agreement between you and America Josh regarding the Service and supersede any prior agreements regarding the Service.
